• I, FOR MYSELF, MY HEIRS, EXECUTORS OR ANYONE ELSE WHO MAY CLAIM ON MY BEHALF, HEREBY WAIVE, RELEASE AND FOREVER DISCHARGE, JEZ-MIR-IZING LLC AND ITS EMPLOYEES, REPRESENTATIVES, EXECUTORS, AND ALL OTHERS FROM ANY AND ALL RESPONSIBILITIES OR LIABILITY FROM PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY OR LOSS OF ANY KIND RESULTING FROM PARTICIPATION IN ANY PROGRAM.
• I DO ALSO HEREBY RELEASE, JEZ-MIR-IZING LLC AND ITS OFFICERS, AGENTS, EMPLOYEES, REPRESENTATIVES, EXECUTORS, AND ALL OTHERS FROM ANY RESPONSIBILITY OR LIABILITY FOR ANY INJURY OR DAMAGE TO MYSELF, INCLUDING THOSE CAUSED BY NEGLIGENCE.
• I understand that strength, flexibility and aerobic exercise offered by Jez-Mir-Izing LLC is a potentially hazardous activity with certain risks and benefits. Some of which are included but are in no way limited to: soft tissue injuries such as wounds, bruises, muscle strain, muscle soreness, sprains, acute strains, broken bones, head injuries, back/neck injuries, knee/foot injuries, heart attacks, death, improved cardiovascular fitness and flexibility, increased strength and muscle tone.
• I understand that fitness activities involve a risk of injury and even death and that I am voluntarily participating in these activities and using equipment with knowledge of the dangers involved.  I hereby agree to expressly assume and accept any and all risks of injury or death.   
• I acknowledge that I have either had a physical examination and been given my physician’s permission to participate, or that I have decided to participate in the activity and use equipment without the approval of my physician and do hereby assume all responsibility for my participation and activities and utilization of equipment and machinery in my activities. I acknowledge that Jez-Mir-Izing LLC has specially informed me that I should receive my physician’s permission to participate prior to beginning any activity from Jez-Mir-Izing LLC and at least every six months if I continue with Jez-Mir-Izing LLC regularly.
• I understand Jez-Mir-Izing LLC, its owners/employees/instructors are not medical personnel, may make no medical judgments, give no medical advice and provide no medical care or therapy.
• I understand that all of the choreography, instructional techniques, as well as the class structure contained within these classes have been created for ‘Jez-Mir-Izing LLC’ by its owner/creator, and fall under copyright/trademark laws as intellectual property, and may not be resold or bartered, for material gain or material profit of any kind. I agree that I will not teach to any third party any of the Proprietary Information and Intellectual Property and that I will not use the premises for the purpose of soliciting any students or employees of Jez-Mir-IIzing LLC or to otherwise compete with Jez-Mir-Izing LLC.
• By execution of this agreement, you hereby agree to indemnify and hold harmless Jez-Mir-Izing LLC from any loss, liability, damage, or cost Jez-Mir-Izing LLC may incur due to the provision of services by Jez-Mir-Izing LLC to you.
• You expressly agree that the foregoing release, waiver, assumption of risk and indemnity agreement is intended to be as broad and inclusive as permitted by the law in the State of North Dakota and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 
• We may use video and pictures of you for social media, website, marketing, ads, etc.
• All will be paid in advance of service.
• All fees are due at time of purchases, unless a payment plan option is available.
• All fees are to be paid monthly by automatic electronic payment (credit card, debit card or automatic checking account draft through Stripe or Pay Pal.
• All fees that are 7 days overdue will result in additional fees and or termination.
• There will be a late fee (7 days past due) $25 per every 7 days late, There is a Decline/Insufficient fund charge of $27 per transaction
• There is a No show/Cancellation/Reschedule fee of $25 per 7 day occurrences.
• If you are cancelling a 3-month, 6-month or 12-month Rise Up program there is a cancellation fee of $1,500.
• The month-to-month membership may be cancelled with an in-writing email to [email protected] 2 weeks prior to cancellation.
• If payment already come out for that month there is no refund.
• There is a $150 month-to-month cancellation fee.
• All purchases start on the date purchased and end on the date purchased.
• Payments come out on the day the initial date your purchased and then every 28 days later until end of term.
• There is no refund regardless if payment went through already.
• One time: ALL payments are due prior to service.
• Term Membership Payments: All term membership and guest fees are collected via auto-debit (i.e. electronic funds transfer) from either a checking account, debit card, credit card.
• By providing your checking, debit card or credit card information you allow Jez-Mir-Izing to automatically withdraw dues and fees as they come due each month.
• Right to Modify Dues: If you are purchasing one-time services, then Jez-Mir-Izing may increase your dues at any time.
• Availability of Facility: Jez-Mir-Izing does not provide an “open gym” facility.
• Members may use the facility only during scheduled classes, scheduled events or by appointment.
• Operating hours and current class schedules are listed on my website at www.jezmirizing.com.
• Jez-Mir-Izing reserves the right to change operating hours and or class schedules at its sole discretion without any effect to this agreement. Limited
• Availability: Jez-Mir-Izing may close its facility for seminars, certifications, maintenance, selected holidays, and other hours based on municipal requirements.
• Jez-Mir-Izing may delete, change, discontinue, repair, or replace any part or all the facility without any effect to this agreement.
• Limited use: If you know or should know you have a problem that might prevent you from using
• Jez-Mir-Izng (i.e. medical, family emergency, business travel, vacations, injury, etc.) and you sign this agreement; you agree that your membership is limited accordingly and because this is your choice, you still must pay your monthly dues as if you use the facility.
• There will be no carryover of monthly dues into subsequent months for any time upon using the facility in a previous month.
• Appointments: All appointments must be made online through a purchased program, package, event, or retreat at www.jezmirizing.com hours before the appointment time available
• Krista is not entitled to respond during non-business hours. You can expect a response within business hours
• There is a 24-hour reschedule, cancellation and no-show policy. If you do not notify within 24 hours, you will forfeit your class and pay a $25 fee. The automatic payment will be withdrawn from your credit card or bank account that is on file with Jez-Mir-Izing immediately.
• Rescheduling is allowed up to one time. If after that, you forfeit the appointment and will be charged $25.00 no-show fee. The automatic payment will be withdrawn from your credit card or bank account that is on file with Jez-Mir-Izing immediately.
• You will NOT schedule appointments back-to-back in the same day. Unless this is approved by Krista. Late Payment/
• Declined Credit Card Fees: A $27 late payment will be due and payable for payments received past the fifth of the month.
• A returned check or declined credit card/debit card will result in a fee of $27. Membership fees must be paid on or before your scheduled automatic payment.
• Members who are not current will not be allowed to participate in classes/treatments after the fifth of the month.
• Cancellation of Membership by Member: All sales are final. If you want to cancel your membership, you will be charged at time of cancellation $1,500.
• If you move and you are no longer here to take in-person classes we will transfer all the classes to a virtual program regime.
• Lost Articles: Jez-Mir-Izing assumes no responsibility for lost or stolen articles. Lost and found articles not claimed after 30 days will be donated or discarded of.
• Smoking, Alcohol, food and drink: No smoking is allowed in any part of the facility or property. Alcohol must be approved by Krista Schafer prior to the special occasion.
• Conduct: Jez-Mir-Izing is committed to the health, wellness, safety, and welfare of each of its members, including staff members. We will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. Jez-Mir-Izing as the right to respond accordingly to the behavior being conducted. This right includes but is not limited to each member-involved termination without any refund.
• Ethics Agreement: I will be kind, loving, respectful and supportive to my coach and my fellow classmates here at Jez-Mir-Izing. I will not gossip, slander, or demean anyone that is a past, current, or future student here at Je-Mir-Izing If I cannot follow the above steps, I will remove myself from the program, membership, class, treatment, etc. without any refund of any sort. I will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior, gossip or slander of any type.
• Jez-Mir-Izing has the right to respond accordingly to the behavior being conducted. This right includes but is not limited to each member-involved termination without any refund.
• Damages: Members shall pay for any damages to Jez-Mir-Izing property that results from the willful or negligent conduct of member, member’s behavior, member’s children, or guests.
• Rules and Regulations: Members who do not observe Jez-Mir-Izing rules and regulations or who abuse equipment in any fashion will be asked to leave. Jez-Mir-Izing reserves the right to terminate any member not complying with this agreement. Not all rules and regulations are listed here, we reserve the right to add, change, or remove rules, conditions of membership, opening and closing hours, and all other services and facilities offered by Jez-Mir-Izing.
• Miscellaneous: This agreement contains the entire agreement between the parties and supersedes any prior written or oral agreement between them concerning the subject matter of this agreement. The provisions of this may be waived, altered, amended, or repeated, in whole or in part upon written consent of all parties.
• Member has read, and fully agrees to the terms of this agreement and understands and agrees that by signing this agreement (which contracts a waiver release and assumption risks)
• Member has given up considerable future legal rights.
• Member has signed this agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her.
• Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this agreement.
• If any portion of this agreement is deemed illegal, void, or unenforceable, then the remaining agreement shall remain in effect. WITNESS our signatures as of the day and date first stated above.
